The Epistle on Legal Theory by Muhammad ibn Idris al-Shafi’i

The Epistle on Legal Theory is the oldest Arabic text in the area of Islamic legal theory. This is also considered to be the most important source that is the basis of Islamic Jurisprudence. The author Muhammad ibn idris al-Shafi’i (d. 20th April, 204/820) was the name of the Shafi’i legal school that is one of the four sacred rites in Sunni Islam. 

This book is the first thorough study in Arabic of the most important issues of Islamic legal thought. It also gives a thorough outline of the importance of Arabic in its function as a channel for divine revelation.

The principles of textual interpretation that are applicable to texts such as the Qur’an and prophetic Traditions, methods to reconcile seemingly contradictory laws and precedents and also the guidelines of inference, and discussions of the situations in which legal interpretation are necessary.

 The author outlines his theoretical theories and includes examples from various areas that comprise Islamic law, including the law of rituals and commercial law and tort law, as well as criminal law. This book provides an interesting glimpse into Islamic laws and the way of thinking in particular and also the earlier Islamic intellectual history broadly.

This Arabic text was created by studying the two main critical editions, and includes modifications to the notes, while the English translation, which is a new translation by a well-known scholar of Shafi’i’s philosophy. The Epistle on Legal Theoryrepresents one of the first comprehensive works on Islamic law. It is vital to the evolution of Islamic legal theory and its position as a part of Islamic tradition-based law.
